EMPLOYER NOMINATED VISA

As the name suggests these visas are essentially sponsored by employers based in Australia for hiring skilled professionals. Applicants opting for this category of immigration need to furnish work order or employment notification, declaration of sponsorship from employer, and relevant supporting documents of professional qualifications.

Permanent Residency Visa (SUBCLASS 186)

The Subclass 186 visa is a permanent residency visa that allows those overseas skilled workers to work in Australia who are nomination by an approved Australian Employer.This visa is granted to indivisuals who wants to live, study and work in Australia for an indefinite period.

The Subclass 186 Visa has 3 streams:

Direct Entry Stream
For applicants who are qualified or have sufficient experience in an eligible occupation. See the Direct Entry Stream tab for specific requirements.

Transition Stream
For 457 visa or 482 TSS Visa holders who have worked for their nominating employer for a minimum of two or three years. See the Transition Steam tab for specific requirements.

Agreement Stream
For applicants who are sponsored by an employer under a labour agreement.

186 Visa holders can:
work in Australia indefinitely
study in Australia
travel to and from Australia for 5 years
enroll in Medicare (Australia’s public healthcare system)
sponsor your relatives to come to Australia
apply for Australian citizenship, if eligible

ELIGIBILITY

186 Visa General Eligibility
You might be eligible to apply for the 186 Permanent Visa if you have an Australian employer who is willing to sponsor you and meet the following requirements:

Sponsor
You must be nominated by a business in Australia before lodging your visa

Experience
Applicants must have at least 3 years of work experience in the nominated occupation.

Part-time work may be considered. Casual work will not be considered.

Age
The age limit is 45, unless exempt. See exemptions in specific stream tabs.

Employer Nomination
Applicants must be nominated by an Australian employer before applying for this visa and must apply within 6 months of the nomination being approved if the applications aren’t lodged together.

Temporary Skill Shortage Visa (Subclass 482)

The Subclass 482 visa is for skilled workers nominated by employers who have a Labour Agreement. It lets you live and work in Australia temporarily. Labour agreements are developed between the Australian Government (represented by the Department) and employers.

The TSS Visa (Temporary Skill Shortage) Subclass 482 has replaced the Subclass 457 Visa. The TSS visa program assists Australian businesses who experience genuine skill shortages and cannot find Australian workers to fill vacant positions.

The Subclass 482 Visa (TSS) has 3 different streams
Short-Term Stream – up to two years
Medium-Term Stream – up to four years
Labour Agreement Stream

TSS visa holders can:
live and work in Australia for up to four years study in Australia include immediate family on their 482 visa transition to permanent residency (if eligible)

ELIGIBILITY

You might be eligible to apply for the TSS Visa if you have an Australian employer who is willing to sponsor you and meet the following requirements:

OCCUPATION

TSS Visa applicants must be qualified or have sufficient experience in an occupation listed on the relevant skilled occupation list. There are three lists relevant to the 482 Visa.

Short-Term Skilled Occupations List (STSOL) Medium and Long-term Strategic Skills List (MLTSSL) Regional Occupation List (ROL) SPONSOR

You must be nominated by a Standard Business Sponsor or a business that has applied for a Standard Business Sponsorship. Your employer must also lodge a nomination application.

EXPERIENCE

Applicants must have at least 2 years of work experience in the nominated occupation or another relevant role. 

Skilled Work Regional Visa (Provisional) (Subclass 494)

The subclass 494 visa is a provisional residency visa available to skilled workers. It is available both to skilled workers who are already living and working in Australia as temporary residents, and to skilled workers living outside Australia.

ABOUT

494 Visa holders can:

• live and work in Australia for up to five years
• include immediate family on 494 visa
• transition to permanent residency (if eligible) via the 191 Regional Skilled Visa

Applying for a 494 Visa The Subclass 494 visa will open to applications in November 2019. To be eligible to apply for this visa, applicants must
• be under 45 years
• have at least 3 years work experience
• have a valid skill assessment
• demonstrate competent English
• meet the health and character requirements

ELIGIBILITY

You may be eligible to apply for a 494 visa
Nomination
You must be nominated by an Australian employer, who is a Stanard Business Sponsor operating lawfully in Australia.

You must be employed in a regional area and working under an eligible occupation.

The nomination application must be lodged before your visa application.

Age
You must be under 45 at the time of application unless you are exempt.

Experience
You must have at least 3 years of full-time work experience, within the last 5 years, before applying for this visa.

Skill Assessment You must have a positive Skill Assessment, in your nominated occupation, from the relevant assessing authority unless you are exempt.

Some applicants may be exempt if; • you hold a 457 Visa or 482 Visa and you were required to provide a suitable skills assessment for this application. • are nominated as an academic (University Lecturer or Faculty Head at academic Level A, B, C, D or E) by an Australian university • you have held a New Zealand Subclass 444 or New Zealand Citizen Family Relationship visa (subclass 461) and have been working for your nominating employer for two years* English You must have at least Competent English to apply for this visa Health & Character You must meet the health and character requirements.

Regional Sponsor Migration Scheme RSMS (Subclass 187 Visa)

The subclass 494 visa is a provisional residency visa available to skilled workers. It is available both to skilled workers who are already living and working in Australia as temporary residents, and to skilled workers living outside Australia.

The 187 visa allows you to
• stay in Australia permanently
• work and study in Australia
•enrol in Medicare (Australia’s public healthcare system)
•sponsor your relatives to come to Australia
•travel to and from Australia for 5 years
•Apply for Australian Citizenship (If eligible)

Include your family
187 visa holders may be able to include the below family members to their application

• partner
• dependent child
• partner’s dependent child

Family members must meet the health and character requirements.

If you already hold a permanent 187 (RSMS) Visa and you would like to bring your family to Australia, you will need to apply for one of the family visas.

Employer Nomination
Applicants must be nominated for by an Australian employer before applying for this visa and must apply within 6 months of the nomination being approved if the applications aren’t lodged together.

The visa cannot be granted if:
• the nomination is withdrawn, or
• the position is no longer available Length of stay This is a permanent visa, however, the 187 visa has a travel component that expires 5 years after the date of visa grant. After this time, applicants can apply for one of the below:
• Australian Citizenship

ELIGIBILITY

You may be able to apply for a Subclass 187 Visa through the direct entry stream if you meet the following requirements:

WORK EXPERIENCE
You must have been working for your employer for at least 2 or 3 years, while holding a 457 Visa or 482 TSS Visa

ENGLISH
You must provide evidence of competent English which can be evidenced by one of the below:
• A valid passport from the United Kingdom, the United States of America, Canada, New Zealand or the Republic of Ireland. or
• IELTS – Minimum score of 6 in each component
• OET – Minimum score of B in each component
• TOEFL iBT – Minimum scores of 12 for listening, 13 for reading, 21 for writing and 18 for speaking
• PTE – Minimum score of 50 in each component or
• 5 years of full-time study in a secondary or higher education institution where all tuition was delivered in English. AGE You are under 45 years of age or you may be older than 45 years if you are exempt. See 186 & 187 Visa age exemptions

HEALTH & CHARACTER Meet the health, character and age requirements (Unless you are exempt) NOMINATION You must be nominated by an Australian employer and apply for the 187 visa within 6 months of the nomination being approved (If the visa and nomination applications were not lodged at the same time) The visa will not be granted if the nomination is withdrawn. The Department does not link new nominations to existing visa applications.

EMPLOYER NOMINATED VISA
